The Brazilian footballer's provisional release from prison is complicated after an expert evidence provided to the Court of Instruction number 15 of Barcelona.
The situation of Dani Alves continues to take a turn for the worse after the latest expert evidence provided to the Court of Instruction number 15 of Barcelona.
The Brazilian footballer is currently accused of sexually assaulting a 23-year-old woman on the night of December 30 in the bathroom of the reserved Sutton nightclub in Barcelona.
However, despite all the attempts of his legal team to grant him temporary release from Brians II prison, it seems the footballer might be set for a lengthy spell behind bars following the emergence of fresh evidence against him.
Dani Alves DNA reportedly found of victim’s body
According to a report from El Mundo, the Court would have already received the forensic reports of the case, which indicate that the remains of semen found inside the victim's body belong to Alves.
Also reportedly found was the samples on the floor of the sink of the premises and those found in the dress that the victim was wearing, which was collected by the agents that night.
The victim would have voluntarily surrendered her dress to the authorities to be analyzed at the Hospital Clínic, to which she was transferred by the patrol of the Mossos d'Esquadra that attended her.
All these biological remains would then coincide with the genetic profile of the sample that Alves himself handed over to the authorities, which would confirm the version of the victim, who states that there was penetration by the footballer without her permission.
Although, one of the several statements Alves previously gave, says that she gave him fellatio and it was consented.
What next for Dani Alves?
With the results of the National Institute of Toxicology and Forensic Sciences on the analysis of the intravaginal samples of the victim, it seems that the judicial siege on the former Barcelona defender narrows every day.
His release from prison is now complicated thanks to the rapid action of the Mossos d'Esquadra, who quickly went to the premises, where they recovered the remains, after activating the protocol against cases of sexual assault.
Currently, the former PSG and Juventus player is in Brians 2 prison in a situation of provisional detention without bail and communicated decreed by the investigating judge for observing clear indications of flight risk, being a Brazil international, a country with which there is no extradition agreement with Spain, and for his economic prowess, which could also facilitate his escape.
In the coming weeks it will be the Audiencia de Barcelona that must resolve the appeal filed by Cristóbal Martell, the lawyer who leads the player's defense team, who requests that he be released from prison provisionally while the procedure is instructed with the application of different measures to ensure that there is no escape on his part.
Why was Dani Alves arrested?
The 39-year-old former Barcelona defender was arrested for alleged sexual assault on a 23-year-old lady at a Barcelona night club.
Alves was taken into custody after the allegation was made against him on December 30, 2022.
He was then taken to the Ciutat de la Justicia, where he attended a court hearing.
He was sent to jail by the court without bail, while an investigation continues on the case.
